Trademark opposition
Once a trademark application has successfully passed the examination of the EU Intellectual Property Office (EUIPO), it is published in the Trademarks Bulletin. The application is then open for others to oppose its registration.
EU trademark applications are open to opposition for a fixed three-month period following the date of publication of the application. This time limit cannot be extended.
The European Union trademark (“EUTM”) opposition procedure enables third parties to prevent EUTM applications from achieving a European trademark registration.
The opposition is commenced by filing a Notice of Opposition at European Union Intellectual Property Office/ EUIPO.
Opposition can only be based on the Opponent’s “Earlier Rights”, namely:
- earlier trademark application or registration.
- other earlier intellectual property rights.
Before the EUIPO, opposition decisions are only taken based on the papers as filed. The opposition decision is usually issued around three to six months from the close of proceedings. The successful party will be awarded costs, but the decision follows a statutory scale and is therefore unlikely to cover the actual cost of the dispute.

How does my EU Trademark work?
The European Union trademark (EUTM) registration is an efficient procedure for obtaining trademark rights in the European Community. The procedure allows for a single application to be filed with the European Union Intellectual Property Office (EUIPO) to obtain protection in all EU countries than applying to each country individually. The EUTM System runs parallel to the trademark legislation of each national EU member state.
First, we check whether the trademark being registered is entitled to protection in European Union (absolute grounds of refusal). Not all trademarks can be registered as trademarks. For instance, merely descriptive terms for the respective goods and services may not be registered as a trademark. To avoid collisions between your trademark registration in European Union and older trademarks we recommend conducting a trademark search in European Union. We automatically perform this service without any costs. We will prepare the trademark registration documents for your approval before the trademark application.
EUIPO checks that your application meets the formal requirements, e.g. that the goods and services are clearly described and the application has been paid for. If all the formalities are in order, your application is entered in the trademarks register and published in the European Union trademark bulletin. A trademark's publication date is important because it marks the beginning of the two-month period in which other owners of trademarks that were registered or applied for earlier can file an objection (opposition) to the trademark application.
